These are the guidelines that are put forward by the staff at Xsessive Game Servers. These guidelines are not negotiable, and will be followed to by all customers of Xsessive Game Servers.

Xsessive Game Servers shall and will have final say in any and all customer disputes as far as for how the server is used, and the Termination of accounts. While we try to be fair to all of our customers, we have on occasion needed to make drastic choices due to gross misuse of servers. This has resulted in a Complete rewrite of our TOS and a new look at how we distribute our services. We as a company and individuals who work for the company have the right to inspect servers at any time. We also retain the right to remove file s that conflict with our TOS, kill processes of files that violate our TOS or and remove accounts that promote a negative image of our company at our will, and without notification.

1) Server Usage Guidelines

. No Server is to be used for non game file storage. While customs maps are ok, there will be No Files of other nature allowed. All file types below have been determined by us to violate this TOS.

. Copyrighted MP3's - Any NON game Music is prohibited from residing on any server we own.

. ISO, BIN, Cue, and the rest of the ISO Types. While we know there are may free games on the internet we are not file storage. Once in a while special needs my arise, Please contact support@Xsessive.com to get clearance. Do not put the file or service up before getting clearance. This could and will result in the deletion of your account with no refund.

. Zip files, RAR Files, and EXE Files. These files are considered NON game files and will violate our TOS

. Gross misuses of Server Resources. Running Shell or Ftp scripts that lag the server out and create a problem for other customers. If you need to run a script for ftp or for stats, consult support@Xsessive.com for clearance First. This includes 3^rd party Anti-Cheat Software.

2) Customer Responsibilities - You are responsible for the upkeep of your server. You are responsible for configuring, starting, stoping, and Admining your server. This is not our responsibility. While we understand that not everyone know how to do this, we will provide a FAQ and Support System for dealign with new admins. If your server is down and will not start, please notify us as soon as possible. Since we don\\\\\'t monitor game servers on an individual basis. You must notify us if your server is experiencing problems or your server is down through our support area of our web site. We want to help limit the amount of downtime you may experience due to server crashes etc. We do not admin your game server. We allow our customer the Power to do that. We only monitor our network to ensure all systems running game servers stay up 24 hours a day 365 days a year. You must insure that your server abides by our term of service at all times.

3) Player Limits - To provide everyone with a value dedicated game server there are limits on the number of players based on the service you applied for. We do reserve the right to inspect any game server to insure they are not exceeding the current max player limit allowed for that account. Violations will result in a 0 strike program. We will issue 0 warnings to a server before termination of service. This includes warning for any and/or all item related violations included in this TOS. No Refund will be given in this case!

4) Modifications - We Offer 1 Free Mod Install on account CREATION ONLY. After that we will install mods and add-ons for a small fee. If you wish to add maps/mods/plugins/addons to your server you may do so at any time. We are not responsible for any Mod, Map, or Add-on you have put on your server. If you need assistance we will help for a mod install fee. If we have installed it we will support it free of charge..

5) Password protected Game Servers - If you ordered a password protected game server there are a few additional requirements you must follow. Your server may not be shared by more then 2 clans. You may not loan your server to any other clans, unless it\\\\\'s a clan you are having a match with. Your server password may not be advertised to the general public but may be posted in order to notify your clan members the proper password. Server passwords may not be posted in the server name. Our password protected game servers (Private Server) is designed for clan use only and is not intended to be used as a public game server.

We are not responsible nor support third party scripts/mods/plugins/add-ons or maps.

6) Setup procedure - All services upon completion of the orderring process will be activated withing a 24 hour perioud. ( but most likely setup instantly )

Pricing

. Prices - All prices are in US. Dollars ($ USD). Prices are subject to change at anytime. New customers will be subject to those price changes. All current customers enjoy the benefit of a Price freeze guarantee. This means you will pay the same amount you paid at the start of service until you cancel service. Your Price will never go up.

. Customized Servers - We pre-install many mods on some game servers. Any Extra Mods we charge $5.95 - $19.95 per mod to customize servers to your taste. As stated above, you can install the mods your self at any time at no charge. This does Not include our pre-installed mods...those are free. We do not support these mods, we only install them. The mod maker is responsible for the stability of his/her mod. In turn we do not Admin your server. This is something left up to the customer. We only install the mod not maintain it.

• Payment - Your payment will be billed 30 days from the date you signed up. We expect payment on that day. Just as you expect your server to be up and running 24/7. We allow a 4 Day Grace period. After the 4 days your server will be suspended and a $10.00 fee be charged to re-activate the server in addition to your Full Payment.
• Rufund/Return policy - Customer agrees to a no-refund policy in advance. Setup fees and monthly service fees are non-refundable.
